What does due course mean?

  • Mr Nick Harden has failed to contact me over 4 years later, in 2019.
  • TRL misleads GSOC on Stopping Distance Formulas as road fatalities continue.

2015:  165 road users died in Ireland and injuries are not available.  The RSA and An Garda Siochana Joined together in releasing the numbers killed, drunk drivers arrested and penalty points issued weekly, but Gardai and the RSA on TRL advice differ on stopping distance from 120 km/h by 50m, 2007 – 2013 and in 2019 by 57m.

  • 01 04 2016:Violeta Bulc appointed European Commissioner for Transport in 2014 said; The current stagnation is alarming. To make matters even worse – provisional figures indicate that potentially even more people died in 2015, compared to 2014.
  • On 31 08 2018, Assistant Commissioner David Sheahan in a letter to Chief Superintendent Aiden Reid, named 16 Gardaí who failed to hand out enough penalty points.

25 08 2015, the RSA outlined that the NCT is to make sure roads are safer for all of us.

13 02 2015: I brought my research discovery to the attention of the Attorney General Marie Whelan in a 93-page report.

On 02 04 2015: The Attorney General responded Reference: 2015/00915 Re: Attached Report in Hard Copy and USB with Affidavit, Driving ScoreCard System, DSCS Book, the incorrect 1946 Highway Code Stopping Distance Formula is a root cause of road traffic accidents 1946 – 2015.

Under the constitution the Attorney General is the legal advisor to the Government in matters of law and legal opinion.  The Attorney General does not have a function in relation to the matters which you have raised but it is noted that you have referred these matters to the relevant authorities and in particular the Road Safety Authority.

  • A stopping difference from 120 km/h of 1.53 seconds 51m between Gardai and the RSA is not a matter for the Attorney General, the RSA or the Garda Roads Policing, so
  • Who oversees the Rules of the Roasd, Highway Code and road safety?

World Day of Remembrance for Road Traffic Victims Sunday 15 11 2015

The Minister for Transport, Tourism and Sport Paschal Donohoe TD, the Environment Minister in Northern Ireland, Mark Durcan, Liz O’Donnell, Chairperson of the Road Safety Authority RSA, Chief Superintendent Mark Curran of the Garda National Traffic Bureau, Assistant Chief Constable Alan Todd the Police Service of Northern Ireland PSNI, Fire & Rescue Services, Local Authorities and road safety groups called on road-users throughout the island of Ireland to join the international community to mark World Day of Remembrance for Road Traffic Victims on Sunday 15th November 2015. In addition, the RSA asked people to change their social media profile picture to add the ‘World Day of Remembrance Candle'.

It was claimed that road fatality records began in 1959 in Ireland, but this is incorrect as Gardai had removed the 1922 to 1958 statistics from their records.

2015 Noel Gibbons, road safety officer with Mayo County Council, won the Road Safety Officer of the Year Award from the Irish road victims association, but road fatalities continued, despite the Awards.

2017:  According to the journal.ie Noel Gibbons ran a campaign in Mayo to raise awareness around driver fatigue this bank holiday weekend aimed at using an image of the iconic Mrs Doyle character from Father Ted, cup of tea in hand, to warn drivers by the roadside.

15 05 2015:  Public Consultations were conducted as Gardai and the RSA attempted to make failing to have a first-aid kit in car to become penalty-point offence, if the battery in the torch was drained or plasters were out of date.  I objected on the grounds, this is not what penalty points were designed for, so it appears to be abandoned or shelved now.  My request to Gardai and the RSA to have all cars fitted with breathalysers was declined on the grounds that breathalysers are not accurate and require calibration annually, while

  • Approximately 600,000 of the 2.5m drivers in Ireland, 1 in 4, who may be as little as 5 km/h over a speed limit may receive penalty points for speeding. The car speedometer, a needle pointing to a mark, may be inaccurate by 10% and is not checked during the National Car Test NCT. Drivers in Germany receive a fine for speeding and do not receive penalty points unless 20 km/h or more over the limit.  In Ireland 1m of the 2.5m drivers receive penalty points annually as fatalities continue.

The Annual International Road Safety Conference 02 04 2015, heard from Speakers; 119 years after the world’s first road fatality occurred in Ireland in 1869, road traffic collisions account for 36.7% of all child deaths, the number of children killed on roads almost tripled last year as 14 children under the age of 15 lost their lives in 2014. Seven were passengers, seven were pedestrians, however

The TRL Highway Code and Rules of the Road Stopping distances are incorrect since 1946.  The RSA and Gardai differ on stopping distance from 120 km/h by 1.52 seconds 51m since 2007.  The following Conference speakers had declined an invitation to disprove my research findings by demonstration while using VBOX:

Minister for Transport, Tourism and Sport, Paschal Donohoe TD, Michael Aherne, Head of Transport Development Division, National Transport Authority, Liz O’Donnell, Chairperson RSA, Velma Burns, Research Manager with the Road Safety Authority, Moyagh Murdock, Chief Executive Officer of the Road Safety Authority, while Aisling Leonard, Senior Road Safety Promotion Officer spoke on the RSA’s Check it Fits project, without mentioning stopping distances.

02 04 2015, Rod King who founded 20s plenty in 2007 spoke for 30 minutes on the advantages of a reduced speed limit based on the TRL designed 1946 Highway Code stopping distances.  Rod King misled the delegates at the conference when he claimed that, “In the distance that 20 mph (32 km/h) can stop, a car at 30 mph (48 km/h) is still doing 24 mph (39 km/h)”.   King also misled the Conference on road fatalities in Britain due to a reduction in speed limits from 30 mph (48 km/h) to 20 mph (32 km/h) as: In 2013 there were 1,713 road fatalities in Great Britain, 1,775 in 2014, 1,730 in 2015 and 1,780 road fatalities in 2016.  King may have been unaware that due to the installation of ramps, almost all roads in 50 km/h areas in Ireland dictate a speed of 10 to 20 km/h on driving test routes and it is not possible to achieve a speed of 30 km/h.

  • Michael Aherne has not responded by 01 07 2019, almost 4 years later.
  • Drivers cannot be trained with dual controls; cars cannot be stopped in the braking distances outlined by TRL.

11 11 2015, ​​​ the Minister for Transport, Tourism & Sport, Paschal Donohoe, T.D. Ref: PD/15/10483 responded I wish to thank you for your email about the red-light running campaign.  As this is a matter under the remit of the National Transport Authority, I have forwarded your letter to the office of Ms. Anne Graham, Chief Executive, for her attention and direct reply to you.

  • Anne Graham has not responded by 01 07 2019, almost 4 years later.
  • Drivers cannot be trained with dual controls; cars cannot be stopped in the braking distances outlined by TRL, and
  • Gardai allow 2.20 seconds driver reaction time while all Amber Traffic lights are set at 3 seconds.

2016:  187 road users died in Ireland and injuries are not yet available.

The vision of the Road Traffic Management Corporation RTMC is: “SAFE ROADS IN SOUTH AFRICA” The Corporation is committed to the reduction of crashes by creating a safe road environment. In 2016, South Africa had 5,410 pedestrian fatalities, 4,608 passenger fatalities and 451 cyclists fatalities.

There were 26 more road fatalities in 2016 in Ireland than in 2012, 4 years after EDT was introduced and the RSA CEO Moyagh Murdock responded, “During the last year 188 people were tragically killed in 176 fatal crashes.  The year 2016 was not a good year for road safety.  The year 2016 saw the publication of four landmark reports by our Research Department. These pre-crash reports looked at garda investigation files between 2008 and 2012. We are unique across Europe in getting such access”.

  • The RSA got ‘access’ after the Gardai removed the 1922 – 1959 and many other statistics.

The RSA Chair Liz O’Donnell responded, “Over the last thirty years there has been an enormous decrease in road fatalities. For example, in 1980 there were 572 fatalities. RSA research has shown that alcohol was a contributory factor in 38% of fatal collisions between 2008 and 2012. Even a split-second distraction can have horrifying consequences”.

  • It is unlikely these statistics on alcohol are accurate as in 2009, 0.48% of drivers stopped at checkpoints were drunk and statistics 1922 to 1959 and 31 fatalities in 2011/12 were removed by Gardai.
  • Drivers over the alcohol allowed limit are not always the cause of the road crash or fatality, and
  • Ads on Alcohol have not worked in the past 55 years since 1964.

The National Car Test NCT, RSA, AA, INAB and NSAI

The National Car Test NCTOn the 21 03 2016, my car was damaged during its NCT and passed by the tester Lorcan. The supervisor Neil 367, NCT Manager John and Automobile Association AA Engineer Keith Doyle agreed it was passed in accordance with EU Regulations and it was claimed it was damaged before entering the NCT Centre, which was incorrect.  I lodged a claim in the Small Claims Court for €262.60, the cost of replacing the tyre and wheel damaged by NCT.

On 12 07 2016, Alexis Moore Applus NCT lodged a counter claim and denied causing damage.  On the 07 08 2016 Alexis Moore offered to pay €130 and on 30 08 2016 offered to pay the full amount claimed but only as a goodwill gesture.  I declined both offers as issuing a Pass NCT Certificate for a car with a damaged wheel rim, buckled and half flat tyre defeats the purpose of the NCT Test.

On 02 11 2017, I again presented the same car for its next NCT and fitted the damaged tyre and rim and it was correctly failed by the NCT tester, solely on the damaged rim and buckled tyre. Applus would only pay the cost of repair as a Good will Gesture, after the court date was set and after months of correspondence.

Applus is ISO 17020 Accredited for the conduct of the NCT and Grant Henderson, General Manager of Applus Car Testing Services is on the Board of the Irish National Accreditation Board INAB, this may be a conflict of interest.

The RSA were issued with ISO 9001, OHSAS 18001 Standards by the National Standards Agency of Ireland NSAI, authorised by INAB and cannot intervene, while

  • The Driving ScoreCard System based on VBOX measurements is accurate to within 2cm, takes 48 seconds 800m to demonstrate to 120 km/h that the TRL designed Highway Code and Rules of the Road stopping distances are incorrect. The NSAI have failed to respond and the INAB have failed to respond to my appeal of their decisions, as fatalities continue.

01 04 2016Violeta Bulc appointed European Commissioner for Transport in 2014 said; Time for Decisive Action Every death or serious injury is one too many. We have achieved impressive results in reducing road fatalities over the last decades, but the current stagnation is alarming. If Europe is to reach its objective of halving road fatalities by 2020, much more needs to be done. I will, for the first time, hand out the 'Jacques Barrot Road Safety Award' in order to give credit to the people that are trying to make a difference. The latest figures are disappointing. Since 2013, we haven't managed to reduce the number of victims on our roads.  To make matters even worse – provisional figures indicate that potentially even more people died in 2015, compared to 2014.

04 04 2019: Commissioner for Transport Violeta Bulc said: While I of course welcome any reduction in road traffic fatality figures, even a single road death is unacceptable. We have been assertive and ambitious in tackling road safety, adopting a strategic action plan, concrete actions on vehicle and infrastructure safety, and a policy framework for the next decade. As we continue to work towards ‘Vision Zero' – zero road deaths by 2050, we are committed to working with all Member States, as well as the Parliament and road safety community, to provide a level of safety that EU citizens demand and deserve.

  • TRL misleads the EU, EC, ED and Violeta Bulc on stopping distances, so fatalities continue.
  • By 2050 one third of the world’s population will probably have died from natural causes.

21 06 2016 and 22 08 2016, I brought my research discovery to the attention of 4 Government Ministers and asked the question, Subject:  Is there Collusion between TRL, Gardai and the Road Safety Authority since 2007?

  1. The Minister for Environment Simon Coveney, with responsibility for setting speed limits and the Government Department that first used the incorrect Highway Code Stopping Distances in the Rules of the Road in 1957.
  2. The Minister for Justice Frances Fitzgerald with responsibility for Gardai who enforce incorrect speed limits and underreport accidents by a factor of 4 and removed fatal crash statistics from official records since 1922.
  3. The Minister for Transport Shane Ross, now with overall responsibility for the use of incorrect stopping distances, driver training in 12 hours with the aid of dual controls and testing the ability of drivers to control a speed of 120 km/h in 50 km/h areas with ramps dictating 10/20 km/h, and
  4. The Minister for Health Simon Harris, with overall responsibility for providing the space, finance and treatment in hospital casualty units for those killed and injured on the roads due to incorrect rules.

29  08 2016, Reference: 0627160336, the Tánaiste and Minister for Justice and Equality, Ms. Frances Fitzgerald, T.D., Responded; A copy of your correspondence has been forwarded to An Garda Síochána for their attention.  Insofar as your request that the matters referred to be examined by the Public Accounts Committee are concerned, I hope can appreciate that the Department has no role in this regard.

11 09 2017: Five people died on the roads in one day 148 years after the first road fatality in Ireland and the RSA Communications Officer Brian Farrell said: "It's been a dreadful day for road safety in this country. If anything is to come from this loss of life, we would hope that it would serve as a reminder that using the roads is the most dangerous thing that we do each day. "We would renew our call, to all road users to be vigilant when using the roads by slowing down, wearing seatbelts and not driving while tired or fatigued."

  • Farrell fails to accept that TRL has provided the RSA and Gardai with different and incorrect stopping distance formulas for 10 years since 2007 and Dr Charles Johnson Competence Assurance Systems has provided and Reviewed the EDT system for the RSA which is incorrect and cannot be complied with.
  • It was 11 years since Gay Byrne and Noel Brett at the RSA rejected my research findings.
  • I again invite Farrell to disprove my findings by demonstration while using VBOX

26 10 2017, I brought my research discovery to the attention of 5 Government Ministers, Subject:    Disagreement, Collusion and possibly corruption involving some members of the Gardai, Road Safety Authority and Transport Research Laboratory.

  3. Minister Charles Flanagan, Department of Justice and Equality
  4. Minister Simon Harris, Department of Health
  5. Minister Paschal Donohoe, Department of Public Expenditure and Reform and previous Minister for Transport
  • Acknowledgements received from some, but a response is awaited from all.

On the 26 09 2016, the RTE Prime Time Programme presenter Keelin Shanley interviewed Garda Derek Cloughley as regard road deaths and he incorrectly claimed that; mobile phones, failing to wear a safety belt, speeding and drinking and driving are the 4 causes of road crashes. They are a cause, but not the root cause.

  • Garda Derek Cloughley misled other Gardai, Driving Instructors and over 500,000 RTE viewers.

On 21 10 2015, Chief Superintendent Mark Curran said, it is tragic to think that one third of drivers and passengers, who have lost their lives were not wearing seat belts. Seat belts do not prevent crashes and did not save the two-thirds who were deemed to be wearing them.

  • A Garda wearing a seat belt died when struck at 180 km/h by the pursued brain bottleneck driver who was not wearing his seat belt. In three fatal crashes where seat belts were worn 4 car occupants were drowned, while 4 were burned alive and unable to leave their cars.
  • Seat belts do save lives, but drivers crash as they are misled by TRL on stopping distances.
  • In 2008, 5% of car occupants killed were not wearing seat belts and this increased to 33% by 2012, after the retired Inspector Michael Brosnan and retired Assistant Commissioner Eddie Rock became RSA Research Manager and board member.
